All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of United Kingdom. 24host makes every effort to backup all websites hosted on it's servers, however, we can not verify that at any given time, we can restore a website from a specific date. To that end, we advise all customers to take the backups of their websites they require.

Domain Name Registrants’ Rights

Your domain name registration and any privacy/proxy services you may use in conjunction with it must be subject to a Registration Agreement with an ICANN Accredited Registrar.

You are entitled to review this Registration Agreement at any time, and download a copy for your records.

You are entitled to accurate and accessible information about:

The identity of your ICANN Accredited Registrar;

The identity of any proxy or privacy service provider affiliated with your Registrar;

Your Registrar’s terms and conditions, including pricing information, applicable to domain name registrations;

The terms and conditions, including pricing information, applicable to any privacy services offered by your Registrar;

The customer support services offered by your Registrar and the privacy services provider, and how to access them;

How to raise concerns and resolve disputes with your Registrar and any privacy services offered by them; and

Instructions that explain your Registrar’s processes for registering, managing, transferring, renewing, and restoring your domain name registrations, including through any proxy or privacy services made available by your Registrar.

You shall not be subject to false advertising or deceptive practices by your Registrar or though any proxy or privacy services made available by your Registrar. This includes deceptive notices, hidden fees, and any practices that are illegal under the consumer protection law of your residence.

If you do not renew your domain before its expiry date, you will have up to 30 days (protected period) to renew the domain name at the original renewal fee. Please log into the client portal area to view renewal fees. After 30 days your domain will be suspended which means all services will stop and will go into a 60 day grace period which you can still renew your domain name (at no extra cost/but with an additional redemption fee of £75). If the domain name is not renewed, it will be cancelled and deleted from the register after 90 days and made available for resale through a third party registrar. will not guarantee the renewal of a domain name.

Domain Name Registrants’ Responsibilities

You must comply with the terms and conditions posted by your Registrar, including applicable policies from your Registrar, the Registry and ICANN.

You must review your Registrar’s current Registration Agreement, along with any updates.

You will assume sole responsibility for the registration and use of your domain name.

You must provide accurate information for publication in directories such as WHOIS, and promptly update this to reflect any changes.

You must respond to inquiries from your Registrar within fifteen (15) days, and keep your Registrar account data current. If you choose to have your domain name registration renew automatically, you must also keep your payment information current.

Confidential Information

All Confidential Information of either Party disclosed to or discovered by the other Party as a result of the provision of the Services shall be regarded as disclosed in confidence and shall only be used in connection with the performance of the Parties’ obligations under the Agreement. The Confidential Information shall not be passed on to Third Party and/or in any way be made use of at any time either during or after the termination of this Agreement, save with the prior written consent of the Party concerned or where the Confidential Information has already entered the public domain (otherwise than through the unauthorised disclosure by the other Party).

Money Back Guarantee

24host shall provide the Customer with a Money Back Guarantee on certain Services, in compliance with Distance Selling Regulations, in order to ensure Customer satisfaction. 24host shall not accept claims that fall outside the Money Back Guarantee Period, nor on products for which no Money Back Guarantee Period is offered.

Payments

A billing cycle is considered a calendar period, so "1 month" is not a consistent period of days. By purchasing a product with us, you confirm and acknowledge we are charging the same amount of money for different amounts of service. Our billing software uses the php date function's computation to figure out the next due date. We tell it to add a month and return the date, which we set as the Next Due Date. Due to the shorter length of February this can cause some unique behaviour which does not happen for the other 11 months of a year. With the above information in mind, renewal invoices are generated 7-14 days in advance and sent to your registered e-mail address. It is your responsibility to ensure this e-mail address is kept up to date and can receive emails from us. It is important that we receive payment on time. All services must be paid for by the due date shown on the invoice unless a written adjustment has been agreed. Failure to complete payment after this time will result in an automatic reminder when the invoice is overdue, and automatic account suspension should the invoice remain unpaid for more than 5 days. Accounts that are suspended will display a default suspension page. This applies to all hosting accounts. If an invoice is unpaid, the related service will be suspended until such time that payment is received and you inform us by email that you have paid, in the case of payments via bank transfer. At this point we will use all reasonable endeavours to restore service within 24 hours. Domain names expire on the day immediately after their renewal date. As such we strongly recommend renewing a minimum of 48 hours before the expiration date. Unless otherwise stated, all payments must be received in UK Pounds sterling. If you pay by foreign bank transfer, then you must be responsible for all foreign currency charges. We reserve the right to alter our prices at any time and will notify you of any alteration by providing you with a written notice. Notice of any price alteration will be sent via email to the email address that we hold for you in your account. If you have already purchased a particular service then the price alteration will only become effective when the service reaches the end of its current term. You warrant that you are lawfully authorised to make payment using the payment card or facility you disclose to us. In the event where you are not the named cardholder, you acknowledge that you and the named cardholder both accept these terms and conditions and are jointly and severally liable for any payment(s) due. You hereby indemnify us in the event that the cardholder or issuer declines any transaction for payment, including our costs in recovering the outstanding amount due. If you attempt a chargeback or dispute a transaction with your bank, we reserve the right to suspend all services provided to you with immediate effect. Services will remain suspended and until such time as the chargeback has been fully reversed in our favour. Where offered, the Money Back Guarantee is limited to the cost of hosting and does not include costs incurred for any domain name(s) or premium domain name(s) registered for the customer nor any custom work order taken out during the Money Back Guarantee Period. Debit/Credit cards details are not stored on 24host servers, they are stored remotely with the card processor, Stripe (https://stripe.com/gb). 24host will retain access to a token that allows for automated captures of credit/debit cards submitted to us, for all future invoices. Cients can request we never perform automated captures by contacting our Support team. Clients can also remove their stored card at anytime from the client area, which will delete the token we store and the card details themself with the provider. Card payments are captured 3 days in advance of an invoices due date.

Save in respect of the Money Back Guarantee and the cancellation rights, customers are not entitled to a refund, whether pro rata or otherwise, if they cancel this Agreement prior to the end of any Hosting Period. 24host does not pay compensation (of a monetary value) and will not be liable for any loss earnings related to a service outage, using any 24host service is an acceptance of this.

Contacting 24host

We offer support via our ticket sytem and email with an aim to respond within at least four hours during normal business hours and eight hours at any other time. All customers have access to their client area 24/7 where actions such as accessing services or paying invoices can be performed without any manual intervention from 24host.

Acceptable Use Policy

The Customer further warrants that he/she shall not:

Send, receive, download, post or otherwise use excessively large volumes of Data Material, which may disrupt the Network Infrastructure and Services provided to the Customer and to other Customers to which 24host may supply Services, including, without limitation, common gateway interface (“cgi”) scripts utilising excessive amounts of the computer central processing unit (“cpu”) and hard-disk read/write functions;

Send unsolicited (spam), offensive, indecent or abusive e-mails;

Send e-mails for the purpose of committing fraud, phishing, or with the intention of committing a criminal offence;

Use the Services in any manner to publish, link, or display unlawful material (as defined by English law and publication regulations or as defined by the laws and regulations of the Customer’s location, situated or resident) and any other material that are pornographic, malicious, abusive, or which encourage acts of violence or terrorism, slander, defamation, or which are in breach of Daily or any Third Party’s Intellectual Property Rights, or which aid the distribution of Computer Viruses or warez;

Send, transmit, make available, copy, retransmit, broadcast or publish (whether directly or indirectly) in whatever form any Data Material or other data, information or contractual rights, material or statement which infringes the Intellectual Property Rights or contractual or statutory rights of any Person or legal entity or the laws or statutory regulations relating to defamation, contempt, blasphemy, infringement of privacy or personal data rights and any equivalent or related laws in any territory in which they are or may be accessed or made available;

Domain Name Registration and Domain Name Disputes

The Customer acknowledges that, whilst 24host shall use its reasonable endeavours to successfully register the requested domain name(s) on behalf of the Customer, 24host shall not be obliged to accept any request to register or continue to process any registration of a domain name.

The Customer agrees that the domain name(s) requested for registration by 24host or any other domain name which the Customer uses in association with any Services provided by 24host shall not infringe any Third party rights or Intellectual Property Rights.

The Customer shall, at all times when using Services provided by 24host, abide by all the terms and conditions of the respective Naming Authority.

24host does not accept any responsibility nor does it make any warranty that the domain name(s) requested for registration by the Customer through 24host shall be accepted by the respective Naming Authority nor available for registration by the Customer or any other Persons for whatever reason and 24host shall not be liable whatsoever for any costs that the Customer may incur if the request for the registration of such domain name(s) is unsuccessful.

24host obligations in relation to domain name registration shall be limited to forwarding the application to the relevant Naming Authority, providing reasonable administration services in relation to the application and notifying the Customer of the result of the application within a reasonable period after receipt by 24host of the result of the application from the relevant Naming Authority.

24host shall not accept responsibility for any liability to any Third Party as a result of the requested registration of a domain name(s) by the Customer, or any other domain name(s) used in conjunction with any Services by the Customer, where such use or registration is in breach of any Third Party’s Intellectual Property Rights.

24host reserves the right, at its sole discretion, to suspend, postpone or cancel any request to register a domain name(s) in the event that:

The Customer has materially breached this Agreement or where 24host believes that it is the Customerís intention to breach this Agreement

There are Outstanding Charges.

The Customer acknowledges that, should any disputes arise out of the registration of any domain name(s), 24host is acting under instruction by the Customer and therefore the Customer shall resolve any disputes in accordance with the respective Naming Authority’s dispute resolution policies:

Nominet – http://www.nominet.org.uk/disputes/ – for all .uk domains;

ICANN – http://www.icann.org/udrp/ – for .com, .net .org, .info, .biz, .name, .tv, and .cc; and

Central NIC – http://www.centralnic.com/support/dispute – .uk.com, .uk.net, .gb.com, .gb.net, .de.com, .us.com, .eu.com.

MOBI domains – http://www.icann.org/udrp/udrp.htm

24host reserves the right to transfer domain names to alternative registrars as and when appropriate for business reasons. Where this is done, domains will regrettably be locked to further transfers for 60 days – however, this will not affect the normal functions of the domain name, DNS or associated services.

IP Address

The Customer has no right, title or interest in the IP address allocated to the Customer by 24host, and any IP address so allocated is allocated as part of the Services and is not portable or otherwise transferable by the Customer in any manner whatsoever.

If an IP address is renumbered or reallocated by 24host, 24host shall use reasonable endeavours to avoid any disruption to the Customer.

The Customer shall have no right, title or interest to the IP address upon termination of this Agreement, and the acquisition by the Customer of a new IP address for the website following termination of this Agreement shall be the exclusive responsibility of the Customer.

Cancellation Rights

Any Customer buying as a consumer has the unreserved right to cancel this Agreement at no cost and without any reason within fourteen (14) days from the date of receipt of the Service Confirmation.

The Customer may exercise the right of cancellation by notifying 24host in writing by post, by email or by telephone.

The Customer agrees that the Customer shall no longer have this cancellation right once 24host has commenced provision of the Services.

Termination

24host reserves the right, without any prejudice to any Clauses within this Agreement and any other rights it is entitled to, to terminate this Agreement without any notice upon any of the following events:

any Charges or Additional Charges for Services supplied or any Outstanding Charges remain unpaid for more than ten (10) calendar days;

the Customer is in breach of any of its obligations under the Clauses of this Agreement;

the Customer materially breaches this Agreement and fails to remedy the breach within twenty (20) calendar days of receipt by the Customer of written notice from 24host requesting that the breach be remedied, stating the nature of the breach and indicating that failure to remedy the breach may result in the termination of this Agreement.

Either Party may at any time terminate any Service by serving the other Party with a written notice signed by a duly authorised representative if:

the other Party shall become bankrupt and subject to a voluntary arrangement under Section 1 of the Insolvency Act 1986 or is unable to pay its debt under Section 123 of the Insolvency Act 1986; the other Party has ceased trading or threatens to cease trading.

Failure to make payment for services, such as web hosting or domain name registrations could result in those services being suspended or terminated at any time.

Effects of Termination

All Clauses within this Agreement which continue to have effect after the termination of this Agreement shall continue to be enforceable notwithstanding termination.

Without any prejudice to any Clauses within this Agreement and any other rights to which 24host is entitled, the Customer shall pay all Outstanding Charges, if any, that fall due at the time of the termination of this Agreement.

The Customer shall cease using all Services at termination and 24host reserves the write to prevent access by changing login details to the Services without notice following termination.

24host reserves the right to erase, remove or delete any Data Material from its Network Infrastructure without notice and without any liability to the Customer following the termination of this Agreement and the Customer shall ensure that it has taken a full back-up copy of its Data Material prior to termination.

Following the termination of this Agreement, 24host reserves the right to cease hosting the Customer’s domain names without notice, whereupon the Customer shall become solely responsible for renewing its domain names with the relevant Naming Authority or through another host provider.

Jurisdiction

This Agreement, and all disputes and claims arising out of or in connection with it, shall be governed by the laws of England & Wales. The Customer irrevocably and unconditionally agrees with 24host that the English courts shall have exclusive jurisdiction over all such disputes or claims arising hereunder.

Marketing Emails

When signing up for an account with us, we request that you explicitly opt-in to receiving marketing emails from us. This action is logged in our billing software, as proof that consent was given, we log the date/time, action performed and IP address. You can opt-out at any time from within your 24host client area.

SLA & Complaints procedure

We aim to respond to all customers, whether via email, ticket or call back within at least four hours during normal business hours and eight hours at any other time. If you wish to make a complaint about our service, please do so first by raising a support ticket or emailing us at complaints@24host.uk. Once a complaint has been raised, you will recieve a response within two working days and if you are unsatisfied with the response, you can request a refund for the remaining time on any hosting service, giving reasons why you feel the service is no longer suitable for yourself and this will be reviewed and responded to again within two working days. You can make a complaint about us in relation to any UK domain directly to Nominet here. We aim to offer 99.5% uptime however where customers need a guaranteed amount of uptime, they should contact us for a bespoke agreement. We guarantee that your website will be accessible 99.5% of the time in any given calendar month, or the customer will receive a full credit towards their next month’s hosting bill. 24host offers various spam filtering services, which aim to help alleviate the spam received to your mailboxes. Due to the nature of spam itself, we can not guarantee that all spam will be filtered by any of our services.
